Legal Online Gambling in Limbo in South Africa

But this has not stopped the online gambling companies to promote their offerings in the country. But this has posed a problem for the Reserve Bank on international transactions which comprise of unlawful online gambling.

According to The Times Live, there is no simple method of narrating the difference between the lawful and unlawful financial transactions, but Reserve Bank can do nothing in order to prevent them. It seems that, The Bank is finding methods in order to obstruct transactions with the offshore gambling sites. The Times reports, disclosing that there is a circular issued by the Bank suggesting the use of national payments system to allow and obstruct the transactions with the offshore gambling sites.

So far the banks have not originally accepted the circular and there are already complaints regarding the implications. Just like other governments, the authorities of South Africa have passed the buck to the banks, to think of a method of judging the difference.

The report also says that it will need full association from the credit card companies in order to find the merchants who start transactions. The Times also noted that there is some legal argument over whether the gambling itself is in violation of the gambling legislation of South Africa, quoting the long-running court case between the authorities and Piggs Peak Casino in neighboring Swaziland, where the online casino disagrees that their online site does not add up to gambling in South Africa and is hence not subjected to gambling legislation of South Africa.

When all is said and done, when it comes to the online gambling where the dollars are involved, the Reserve Bank wants to stop, says The Times, going on to inquire if the charges of picking up on unlawful transactions have any value, particularly when it would not be hard for the merchant to get around the exclusion by reclassifying himself.

In the meantime, online gambling carries on to inhabit the limbo-land of South Africa, where the government appears in spite of so many years of discussions, hearing, and research.
